Terms of service

These are the terms on which we offer memberships and services at Apex Performance Labs. By paying for a membership, a module, or a session pack, you agree to them.

The agreement

The agreement is between you (the member) and APEX PERFORMANCE LABS (PVT) LTD, registered in Sri Lanka at B 05/05, Royal Park Condominium, 115 Lake Drive, Rajagiriya 10107. Services are delivered at our gym branch: Alpha, Melbourne Avenue, 36 Melbourne Avenue, Colombo 4.

A copy of these terms is available at trainatapex.com/policies. By signing a membership agreement or making payment, you accept these terms as amended from time to time. Continued use of the facility following any amendment constitutes acceptance of the revised terms.

Membership types

  • The Apex Protocol. Structured five-phase progression (FOUNDATION through APEX, 8 to 12 weeks per phase). Coached sessions in a capped group, with optional clinical assessments and nutrition tracking via the Apex app.
  • Freedom Membership. Annual base membership at LKR 80,000 per year offering flexible gym access. A drop-in fee of LKR 5,000 per session applies to use the training floor.

All prices are in Sri Lankan Rupees. We may revise fees for new sign-ups; your committed membership continues at the rate agreed at sign-up.

Membership fees & billing

Fees are due at the intervals selected at sign-up (monthly or in full). Late payment may result in suspension of access until the balance is cleared. Applicable taxes, duties, or levies are the responsibility of the member. Card payments are processed by DirectPay Sri Lanka via a unique link issued by our staff. Receipts are issued by email.

When membership begins

Your membership starts immediately once payment is received and these terms are accepted. Where a waiting list is in operation, your membership commences on the date we notify you by email.

Refunds & cancellation

Membership fees are non-refundable once paid, except as required by law, in the event of medical disqualification before training commences, or where Apex terminates early through no fault of the member. You may cancel your membership at any time by notifying us in writing. Member conduct

  • Provide accurate medical, contact, and personal information at sign-up and notify us promptly of any material changes.
  • Use equipment and facilities properly. Consult a staff member if you are unsure how to operate any equipment.
  • Treat all staff and fellow members with respect. Inappropriate, intimidating, or offensive conduct in person or via any communication channel may result in immediate termination of membership without refund.
  • Commercial activity, acting as a personal trainer for others within the facility, or soliciting business from other members is prohibited.
  • Use or promotion of steroids or prohibited performance substances is strictly prohibited and will result in immediate termination.
  • Appropriate sportswear, clean training shoes, and a personal towel are required on the training floor.
  • Return all equipment to its original location after use. Do not drop or slam weights excessively.

Junior members

Children under the age of 12 are prohibited from using the gym facilities. Members aged 12 to 17 must be accompanied by a parent or guardian who signs the membership agreement on their behalf and completes an induction.

Facility access & closures

Access is via a secured entry system and requires identity verification. Apex may close the facility on public holidays or for maintenance for up to five (5) days per year, or for periods outside our control. Closures of this nature do not constitute a breach of these terms and no refund is due for the period of closure.

Assumption of risk

Exercise carries inherent risk. By becoming a member you confirm that you are in good health to the best of your knowledge, have disclosed all material medical conditions to the APL medical team, will follow your coach's instructions, and voluntarily assume the risks associated with high-intensity training including, but not limited to, abnormal blood pressure, fainting, heart disorders, and musculoskeletal injury. APL does not guarantee injury-free participation.

Liability

To the maximum extent permitted by Sri Lankan law, Apex's liability for any claim relating to the service is limited to the fees paid by you in the twelve months preceding the claim. APL is not liable for loss of, or damage to, personal property brought onto the premises.

Force majeure

Apex will not be in breach of these terms where failure to perform is caused by events outside our reasonable control, including acts of God, flood, fire, civil disturbance, government action, or industrial action.

Intellectual property

All content, training materials, app deliverables, and associated intellectual property remain the property of Apex Performance Labs (Pvt) Ltd or its licensors. Members may not reproduce, distribute, or commercialise any such material without prior written consent.

Governing law

This agreement is governed by the laws of the Democratic Socialist Republic of Sri Lanka. Disputes shall first be addressed through good-faith negotiation and, if unresolved, referred to the courts of Colombo with competent jurisdiction.

Changes to these terms

We may amend these terms from time to time by posting the revised version on this site. We will notify you by updating the date at the top of this page. Continued use of the facility or service following an amendment constitutes acceptance.
